Hi I have sent a customer a letter before action by recorded delivery. It has been returned to post office as no one was there (apparantly) to sign for it. I'm guessing g they know what it is so won't collect from post office. Can I still start legal proceedings? I can't personally hand deliver as they have huge gates and dogs so I can't actually get to the front door!

I dont think you need to send it by recorded delivery. Sending it to the last know address by normal mail is adequate.
It's possible you may acheive a CCJ because they didnt respond/attend the hearing or just be given a default CCj. They can apply to have it set aside and the Judge may set it aside on the basis they didnt receive it and therefore were not able to defend themselves.
This only delays the process though.
How about disguising the letter by putting it in a hand written envelope inside a greetings card? and sending it again by recorded delivery? that might fool them into signing for it. You can see a letter that has been returned to the post office but not open it unless you sign for it so do not anything on the envelope that would identify it.
