I have been charged under section 39 of beating my wife and pushing my son of 15 in the face i attended court last week and has been put back to the 20-9-10 due to the defence papers not arriving in court on time i intend to plead guilty to both charges

but am now having a change of heart having seen my sons statement(i did not want to get my son into court to go through all the questioning) what can i expect to get as a maximum sentence ive tried to speak with my solicitor with out much joy.

So, for beating your wife and punching your child, you have no idea what punishment you think you should receive?
Could i just ask what your age is, have you any previous convictions and what are your mitigating factors? Also were you under the influence of drugs or drink?

I apologise for the mix up. I just thought it would be interesting to hear what you thought you deserved and not what the far too leanient laws of this country dictate.

my age does not matter over 21, i have no prev, and i was not taking drugs, and my wife and i have been having problems for the last few years, and yes before you ask i do have a quick temper and can be pig headed but this has never happend before.
I wonder if having a quick temper is anything to do with the predicament that "tazzboy" finds himself in. Not sure what type of mature man would call himself anything "boy" either.

Personally tazzboy - I think that maybe you would benefit from some help to understand why you did what you did and to stop you doing it again, maybe volunteering for this or at least finding out what was available for you would show a degree of remorse and proactivity that would go in your favour when the judge decides what sentence to hand out.

I guess that your son has written things you dont agree with - I would find this upsetting rather than be seeking to gain some revenge on him, I would be wondering why he feels like that and working out how I could rebuild my relationship with him.

You say you intend to plead Guilty so I assume you must have done both of these things?

bobisox i did not beat my wife i hit her once, once to many i know my saw this and tried to protect his mum and i pushed him away im not looking for anything but help?

Hi, Section 39 is a summary only offence, so it will stay in the Magistrates' Court. The maximum penalty in the Magistrates' Court is a six month prison sentence. Whether you go to prison will depend on the circumstances, etc. Hope that helps.
I think I would still try to spare my son a court appearance, unless you think his statement is maliciously wrong and absolutely must be contested.

I believe the sentence is lower if you plead guilty and save the court time. It sounds as if you agree you are guilty as charged, in which case pleading not guilty is unlikely to do you any good and may do you harm (by increasing the sentence).

Get a good lawyer, unless you are confident in your own ability as a public speaker, and make sure your explanation is put clearly. Show remorse, which you seem to feel. Consider signing up for some sort of anger management course: it may impress the court, and it may help you with your relationship in the future.

jno I still intend not to put my son through court, i do have a solicitor when i can get hold of him and am looking to sign up with respect with regard to anger management

well you do seem genuinely regretful of this tazz, I apologize if I have come over rather harsh on this but as recipient of a violent first marriage I will never understand a man hitting his partner, nor indeed the other way round

At the moment my wife is living with friends until after the court case as i have 3 conditional bail restrictions on me, but hope to be able to see wife after court case to discuss things with the possiibillity of being able to sort things out.
