Am I entitled under the freedom of information act to know how fast a driver of a speeding bus was doing? The company say they are looking into the matter and dealing with it internally. Is this allowed? I am sure the driver was at least over the speed limit by 40% most of the journey! I have asked the company if they will let me know the speed reading, and I am waiting for them to get back. However I would really like to know if they have to let me know under the 2000Act. The provisions of the Freedom of Information Act only apply to bodies in the public sector (such as local councils and Government organisations). They do not extend to individuals or private companies (such as the bus operator).

Further, buses operating within a local area (which means most UK bus operators, except coach companies) are exempt from tachograph regulations. So, unless the vehicle was fitted with a tracker feeding data to a recording system, there might be no way that the bus company can check on the speed of the vehicle.
