My boyfriend has recently been changed with the above offence. He has no prior offenses and has been remanded into custody. The reason for him being denied bail is because of the severity of which the assault was caused. There have been no major injuries but strangulation was a factor. Is there any likelihood that the charges can be dropped.

Totally agree with bednobs, how on earth is anyone expected to give any kind of advice from what has been posted. Very much reminds me of a similar link, scroll down. I would suspect there is more to this than what has been declared, which has been deemed sufficient to justify this charge.

The severity of the assault is not a reason to deny bail.

To be remanded in custody there must be grounds to believe that your boyfriend may either:

- abscond (i.e not turn up at court when required or

- commit further offences or

- interfere with justice (particularly witnesses).

From what I have been told he made comments to the police when he go arrested which they say could be used as a admittance of guilt. I have no idea advice given by his solicitor. I do now that a similar instance is recorded in the statement although the police were not called. My question remains the same. Can the charges be dropped.

S18 is very serious and it is almost always a prison sentence.
Strangulation is a serious injury! He could easily have been on a murder or manslaughter charge.
I am puzzled as to why you say 'there have been no major injuries' .We need a lot more information. If an offender is remanded to custody it means the police consider that another offence may be committed if the offender is allowed to remain out of jail. So I can't see the charge being dropped.

I'm not familiar with the judicial system in the UK. What I do know is the contents of the statement. Preliminary hearing was held and bail denied. And the charges is Section 18 GBH. He has been remanded in custody till October.

I know but muggins here is feeling guilty and sorry for him. I had read through different sites and most answers were no. I also would be questioned if I change my statement and could be prosecuted myself. Thank you for your advice.

He probably is sorry but more that he got caught than anything else. As to never doing it again. I highly doubt that. Abusers never stop.

If he has said that he is sorry you can expect that, but only sorry until the next time.
