I'm looking to make a written complaint to jdwetherspoons about an incident that happened on one of there premises.
A group of young men who had been drinking all day watching the rugby decided it would be funny to abuse my wife over her age . With out going into detail of what words were used she was very upset .
Having spoke to the manager I could get him to understand that how they treated my wife was no different to some of a different race being racially abused because of their colour .
What I need to no is there something written in law that covers this to in my letter of complaint .. Thank you

Ageism is a protected characteristic, meaning that one cannot be discriminated against the result of ones age. However, was this just banter gone too far? Is it really weatherspoons fault? I'd imagine the 'abuse' wasn't personal. Teach your wife to stand up for herself, to give as much stick back as is thrown at her.
Why are you complaining to Wetherspoons? It was not a member of staff that was abusive it was customers. The pub can not be held responsible for something a customer said.
I can see your upset, and the reasons for it.

Did you speak to someone about it at the time? If not, it's impossible to get any reasonable action taken without evidence and / or witnesses to what happened.

Insulting or abusive words or behaviour is an offence under the Public Order Act
If the manager had refused to tell the drunks to cease their abuse or leave, then that is sufficient as a reason for complaint.

The content in this instance isn't in my view relevant.
If they were obviously very rowdy and drunk and upsetting other customers, surely Wetherespoons should have kicked them out ? Your poor wife.
^^ exactly, but how do you prove it ? Unless there was a CCTV recording with sound there is going to be no way to do anything, and action can only be taken against the people who were abusive not the pub. I don't suppose you got their names and addresses?

I'm not blaming witherspoons for what happened and giving it back then results in the two parties have a argument which then makes us no better than them . But at the end of the day like I said they were very drunk and its wetherspoons that's taking there money which to a point must make slightly responsible . I just felt after making a complaint a word in there ear about there actions would have been some kind of result but there was nothing.
Did the manager refuse to do anything? that would be your only ground for complaint .

If a group of drunken young men in a pub upset your partner and you walked up to them all you get back is a nude you be no better than them and would more than like be kicked out as a trouble maker so the alternative is to do nothing and grit your teeth or speak to the manager .
If the Manager handled your concerns badly then by all means lay your concerns out in a letter to the company - if he witnessed the abuse he could very easily have moved the drunks on.

Manager did nothing but agreed that he could see that my wife was clearly upset over the incident.. Still write if to do nothing but get it off my chest

scroll down to "drunkenness and disorderly conduct, I hope this helps.
"Insulting or abusive words or behaviour is an offence under the Public Order Act."

Not any more it isn’t, danny. In 2014 the word ”insulting” was removed from Section 5 of the POA. However “abusive” words or behaviour still constitute an offence and the line between the two is often hard to draw:

Of course woofgang is quite correct, serving somebody who is drunk (or a person under age, a police officer in uniform or a working prostitute) is an offence. Most town centre pubs will almost be guilty of this in the course of a week.

However the police or local authority will not be interested in taking action in either of these circumstances. Your best bet is to appeal to Wethers’ good nature. I have had some “customer service” dealings with them and although they responded quite well I got the impression that they were somewhat going through the motions. Of course they should keep an orderly house but their idea of orderly and yours may differ !
^^^ "..almost certainly be guilty.."
We do not know if they were disorderly before this incident or if this was the 1st instance. The manager can hardly be responsible if this was the 1st instance of bad behavior.
