Can an executor sell a property below market value?

My father passed away and stated in his will that 2 apartments he owned should be sold and the profits split 50/50 between myself and his wife. The executor was claiming that he wanted us to keep them instead, and now (more than 3 years and many emails later) he is saying he will sell them for about half market value.

He is also refusing to give me statements showing exactly what has been collected in rent from the 2 apartments over the last 3 years.

What can I do?

The executors absolutely must not do this. He should sell at the market price. He also has a duty to account to the beneficiaries under s25 Administration of Estates Act 1925 for ALL monies received during the administration (including rent).

I would be inclined to seek legal advice with a view to seeking directions from the Court under CPR Part 64 (which deals with disputes on estates). It is a complicated area though so you really should seek specialist advice.
