how do i get a refund?

i bought a mobile phone, it didnt work at all, i phoned the store that day & told them that night and tried to take it back the next day, they told me they dont do refunds only replacements but they havnt another of the same model so i dont want a replacement. am i entitled to my money back?

this is in sefton/liverpool uk

Write a letter, quoting the 'Sale of goods act 2003',

You are entitled to a full refund as it is faulty under the Sale of Goods Act 1979.

S.14(2) requires the goods to be of satisfactory quality. A phone that doesn't work clearly isn't.

Your contract is with the shop, not the phone manufacturer or anybody else. It is the shop that must give you the refund.

Go back to the shop and ask to speak to the manager. Tell him you want a full refund and if you don't get one you are going to report them to Trading Standards and start proceedings in the County Court using the Small Claims Procedure.

There is no Sale of Goods Act 2003, by the way, so don't quote that.
My apologies, on that, I know the law on electrical goods, but couldn't remember which year the sog act was, so googled, and came up with the above.

hey, thanx for ya answers, the shop claims that because they have a sign up saying that refunds arnt available on mobiles that its legal? also spoke to trading standards & just got told to write to the shop and wait 14 days then get back to them.
It is not legal. They cannot avoid their obligations under statutory law by placing signs up.

Go to the shop today when it is really busy and kick up a stink.

Say very loudly (but don't be aggressive), 'You have sold me a phone that has never worked because it is faulty. I want the refund I am entitled to by law'.
you are entitled to a full refund under consumer trading laws as the phone didn't work and they don't have anoither - the model you want.

i also have to say i agree with ethel. if i have problems of this nature, i pick a day where i am not working, go back to the shop and spout off a bit to try and get the refund and if they refuse, tell them i am free all day and will stand outside their shop (on public property) and tell all the customers coming in about their dreadful customer service and non-adherence to trading standards laws. the record (for me) as it stands is telling three customers, before i got a refund, apology and �25 for my troubles. as long as you remain polite, adhere to the law, there is sod all the shop can do. i find saturdays work best, around 2-3pm. have fun!
