There is no defined NOK it is whoever the person chooses to appoint.
Whomever he wishes but it would normally be his son.
In the event of no will, or instruction from the deceased then it would be the nearest relative.

Hi Thanks for your help. How does he appoint me? Does he have to go through a solicitor? He lives in Luxembourg.
Do you have any particular responsibilities in mind? Are you asking about your brother's NOK of his son's NOK? It's really up to him to decide on this isn't it?
He should be able to find a solicitor there,
In the UK you just appoint someone on medical forms etc. It gives you no legal rights. You just become the person they contact in an emergency.

I've nominated my Uncle as NOK because most of the time my OH is with me and my uncle owns a pub so they'll be someone about to answer the phone.

My brother has asked me to help him in a medical situation. His son is not willing to help him.
He just names you as NOK on any medical forms then if he wants you to be the person the hospital/medical staff contact

he just names you - Barmaid who is never wrong says it is the heir at law ( that would have been ) before the 1837 Wills Act. Gives you some idea of the force it has at Law

what is much more important is that he leaves a will - which he needs advice - two possibly - one for his English Assets and one for his Luxemburgish ( ha!) assets
or one will that works in both countries which I can tell you for starters none of us can advise about - oh his English will must NOT contain the words - "and I revoke all other wills"

and you will be unsurprised to learn that I have no idea at all who his next of kin is in Luxemburgish ( ha! ) Law
