I went for advice about a housing problem and came out feeling like a criminal.

Anyone else got this feeling after a visit to CAB ?

I have used CAB twice and both times it was useless. I wasn't made to feel like a criminal, though.

I have heard excellent reports from other users so I assume I was unlucky

I have had a section 21 notice served on me after 25 years paying rent on time,
so i thought as there was a few discrepancies on the notice and the tenancy agreement i could at least get a bit more time to vacate the property,
but was told its all irrelevant and if i fight it i will get the costs of the court .
Have you been given at least two months to vacate, phil?

Also the CAB said i have no right to be given the owners name and address , but Shelters site says its a criminal offence if the letting agent does not give me the owners name within 21 days of me asking by recorded delivery .

Yes the section 21 says 2 months , but thats nowhere near enough time to find another property.

You seem to have a very poor CAB. In all the dealings I have had with mine they have been brilliant. How did the 'make you feel like a criminal'??
They are volunteers you know?
I have found them to be very helpful to people who i have recommended them to
very good on debt

and very helpful on appeals for benefits

altogether well worth the money ( er that I dont pay but I pay thro taxes )

I felt like i was living in a house that i had rented for 25 years and was being told its the owners property and they want it back so they can sell it .
My reason for wanting to know who owns it is that the letting agent has not replied to my email with a price to at least give me the chance of buying the property, maybe they just want me out so they can increase the rent.
They are not all volunteers, sinderella. A generalist adviser, working 22.5 hours a week, will be paid around £13k in Lincoln

I will carry on paying the rent and let them get a possession order and see where that goes .
O good this is in law section

s21's are governed by straightforward statute and case law
If it is on a preprinted form it is probably pukka
they [CAB] would know

what do you think is wrong with it ?

Once properly done it is really all automatic ( accelerated possession )

the grounds usually successful is that the s21 notice is defective or
the deposit was not paid into a scheme ( doesnt apply to you)

on the facts given
you were given good advice
( and told not to waste your money)
find somewhere else and move out

If the S21 has been correctly served there is little , if anything, the CAB can do. Are you single philkool or are there other family living with you?
You need to apply to your local council for emergency accommodation, I am astounded the CAB did not tell you that!
Shelter are very good in this situation, better than the CAB !.
No DON'T let it run to a possession order
and then think "oo-er where am I gonna live now ?" - I was given 8 weeks and now I have eight minutes !

the stats for that is .... 90% lose all their possessions
[ Close the door and walk down the street on The Day - and never collect possessions which then go into a skip ]

They have a free telephone advice service call them!!!
They are a lot better than the CAB as this is all they do !!
Please call them, it will cost nothing and at least you will get correct unbiased advice!

we dont know if they did

some council show no interest until someone turns up with children and say I have been kicked out and I have nowhere to go

One possession order I got - they came back and said - it is dated and not timed so the council has said it is not valid
and I said 'close of play on the day that is 1700 on 21st whcih I note is after the council offices close
and they said they wont do anything
and I said you are still out

which he needs to act on and not say to us
can I have a second opinion please the first lot of advice was crap ?

The section 21 has a dissolved company as the landlord , where as the tenancy agreement which i had to ask for on 5 occasions has another name as the landlord , also the land registry search shows a totally different name as the property owner .
