car insurance and expired MOT - am I still covered?

I had a car accident in which I was at fault but no one was injured. My MOT ran out in January - through oversight not by intention. Will my insurance still cover me ir will it be invalid. All my policy says that the car should be 'roadworthy'.

There was a question similar to this on answer bank a few weeks ago I think. I believe that there was a case mentioned of a guy who was stopped by the police and found to have an unintentionally expired MOT. They prosecuted him for that, and for having no insurance, saying that a condition of having insurance was that the car must have a valid MOT. Your insurance policy wording that your car must be 'roadworthy' sort of implies that, as the accepted test of roadworthyness, in law at least, is a current MOT. I guess you should phone your insurers to ask their position on this. Good luck!
If your car was parked off the road on your drive and you were not in it it would be diferent.

Insurance company would probably say that you should have had the new MOT sticker somewhere in the car to remind you when it was due again though.
Insurance companies will find any reason not to pay out. Not having a valid MOT would be a fairly strong argument as the car isn't legal on the road without one.
