Dreaded Conifers

The house next door has large conifers along its boundary and they have lifted up my drive and cracked our boundary wall. The house is empty at the moment as a property developer bought it two years ago. Anyone know how I can get him to repair the damage without a huge cost in legal fees to myself?

I can't say for definite but I would imagine that as he is the owner of the property at present, then he is repsonsible for its upkeep and maintenance and subsequently any damgae it causes to neighbouring properties. In which case whether it costs you a lot of money or not he will be liable for costs when found guilty- I don't think there's much chance of you being found responsible!!

Have you tried talking to him first? If he doesn't respond then you let him know you are having the work done and will be sending him the bill. If he doesn't pay within a reasonable time, after warning him you take out a County Court summons for the amount owed and attend court yourself to put your case. This is assuming he is liable, anything on your property can be cut off and given back as it belongs to him so I suppose he should be liable.
