i have asked this question in an earlier thread and i got advised to see a solicitor.i have spoken to a solicitor and he has advised me to go to the halifax (thats who the mortgage is with) give them his name and phone no and they will do the rest at a cost of about �400 for the solicitor and �160 for the halifax he also asked me if my wife agrees with her name getting removed from the mortgage and she does he has told me my wife needs to get a solicitor as well. what i thought we could do because everyone is in favour was get a valuation on the house and whatever it is worth today she will get half when are daughter leaves full time education because i am paying the mortgage myself at the moment (please advise) !

i went through something similar a few years ago. i ended up using the same solicitor for me and my then partner and also had to pay the fee to the building society.
Does your wife agree to this?
Does Haliax agree to this?
I completed this 4 days ago at a cost of �264.38 + vat.
Another thing to consider is the signing of a "Transfer of Equity" form.
If your wifes SHARE of the property is �125 ,000 or more stamp duty is payable at 1% up to �250,000.
3% for �250,000 - �500,000.
4% over �500,000.

What happened with me once the remaining mortgage was paid off our shares were less than �125,000 so no tax was payable.
The best option is to agree on what is to be done(I borrowed the money to pay her off by re-mortgaging the marital home) and only use ONE solicitor.
Remember they are in it to make money!

yes the wife agreed and the halifax agreed.
at the moment the house is valued at 160,000 pounds we owe roughly 50,000 off the mortgage because my wife has set up home with someone else we have agreed that we get the house valued and when my daughter leaves full time education she will get half of the valuation price (the price it is worth now) but i will not be selling or buying her out for at least another 5 years,but i will be paying the mortgage myself from now on
