I have had a contract cancelled shortly after signing because of the Salesman's errors. The Scottish company are refusing to refund my deposit saying it has been paid to the surveyor . I feel my deposit should be refunded as the contract has been cancelled.
How do I stand in Scottish contract law?

Was the contract signed off premise eg. not at their showroom, but at your house?

It was signed in my house (interesting point to ask T, how is that relevent?) and it was cancelled a day after the cool off period...7days from memory. They didn't inform me at the time.
Its relevant when and where you signed, and also where you agreed the contract.
