My dad opened up an account for me when i was a little girl under his name.Although my name does show on the account, the bank has told me that he needs to sign control over to me if i want to be able to access the funds. As i don't really want to talk to him, my question is will i get into trouble if i use the account number and sort code to pay a bill? There is only £50 in there and it's registered to my mums address so i don't think he'll ever find out, it just seems a shame to let it go to waste

this is not really a T acct as we know it is it?

S2 Fraud Act in the UK is a conduct crime - all you have to do is issue a document which is false - loss is not required. This clearly would be involved

oh, no it's good that you're telling me.
the account name is my dads name tee my name. Is it really fraud if I just provide the account number and sort code, I think that's all my phone provider needs

. . . but intent is:

"A person is in breach of this section if he —

(a) dishonestly makes a false representation, and

(b) intends, by making the representation—

(i) to make a gain for himself or another, or

(ii) to cause loss to another or to expose another to a risk of loss"

If the money is yours (even though your father may still have 'control' over it) it's hard to see you could be said to be seeking a gain for yourself (or a loss for your father) by trying to make use of it.

Your problem might be that bills can normally only be paid from current accounts, which won't be the type of account that your father placed the money into.

thanks chris, some good information there.
@ peter, you've got to make a false representation as well, which I don't think i am doing as the money is technically mine.
Think I might just try and spend it, although chris might be right about not being able to as it's not a current account
