Hi I'm signed off work due to illness and have disability to I have
Been told I cannot get ESA or JSA due to me having
A partner who works full time and gets over
The minimum wage are there any benefits I am entitled to
Please get back to me asap please as now desperate
And he cannot get carers allowance for me

when you say signed off work, what do you mean? If you are just signed off sick from your job for a spell, you won't be able to get JSA (seeing as that you are not actually looking for work)
or do you mean you don't have a job at all? If so, when did you last work and for how long?
JSA (income based)is means tested although I'm not aware that the minimum wage determines the cut-off point. Contribution based JSA is for those actively seeking work.
Who has advised you? If it's the DWP or CAB then they are probably right.
If you are an employee don't you get sick pay or SSP?

Hi I'm signed off by the doctor until I'm well its because my partner gets over minimum wage and works over 35hrs but I should be entitled to something shouldn't I I'm on DLA as well he cannot get carers allowance as he earns to much and he is my carer as well I have been called on a medical assessment so will see what that comes up with

If your partner earns more than £110 a week he cannot get Carers' Allowance.

As you have been in work and are now signed off sick you should be entitled to Statutory Sick Pay.

I haven't been we was on joint JSA now he's got a job I was on ESA before now trying to get back on it is there anything I'm desperate
Sorry but what do you expect? You have a partner in full time work and you get DLA. Your partner may be able to claim Working Tax Credit based on his wage. Your DLA will not be counted towards that.

You can't get ESA and DLA at the same time, it's one or the other.You are better off on DLA as that gives your partner more money on working tax credit.
Unless the rules have changed very recently you can claim both ESA and PIP (the new DLA) at the same time.
i am really puzzled - why were you getting joint JSA if he works? Also, i still can't quite comprehend if you have a job that you are signed off sick from or if you don'r have a job
I think:
OP gets DLA. She nor her husband were working and her husband claimed JSA for both of them.
Husband now has job and OP has tried to claim JSA or ESA in her own name

He didn't have a job we couldn't be on 2 different I was on it as have depression and anxiety who's op and the rules have changed if your not in a relationship you can get it will look at eESA and DLA together
esa for first 12 months is contribution based if you have suffiicient credits of NI..thereafter income based and if you have a partner who is in FT employment you will not be eligible...pip is new DLA benefit ...ask to speak to a benefit adviser at Job Centre ..they will tell you what you can get if you ask specific questions..ie what other benefits can I apply for other than ESA

Sorry io can't answer directly as I'm still not clear what the situation is abd what you mean by 'signed off work'. Have you have checked with the benefits office and maybe Citizens Advice or whatever it's called now?

You still have not said whether you are employed and are off work sick. If that is the case then - as already stated - you get statutory sick pay. It is up to your employer to pay it.

If you do not have a job then you may be able to get ESA (as well as DLA - you can have both). However, from what you have said you cannot get the means tested version of ESA because your partner earns too much and you will only be able to get the contribution based version if you have worked and paid national insurance contributions in the relevant years. DWP should be able to tell you whether you have done so.

As already said, you may be able to get working tax credit (& child tax credit if you have children), depending on your partner's earnings. You may also be able to get some housing benefit if you are renting, and some help with council tax.

If you can't follow all this through yourself visit your local CAB for a benefit check and advice.

I know I've asked this before but I can't see an answer. You say I'm signed off work due to illness". Are you still employed then? If you are an employee don't you get sick pay or SSP for a period? How long have you been off sick?

Have been off work for 2yrs was receiving ESA but then got told to go on a joint claim of JSA now my partner is working and I can't get anything have a medical assessment so will see what happens with that
