Regrettably YES. It is the drivers responsibility for all things to do with the vehicle he is driving - of course the owner of the vehicle is also likely to be punished. At times it may be harsh on the driver who is simply driving, but that is the way it is.

Yes, as the driver you are responsible for all aspects of the vehicle, including insurance, MOT, road tax and roadworthyness
