Non - Compliance Of Lump Sum Payment Court Order

This is rather a quick question re variation of a a final order. My ex was ordered to pay me a lump sum following a divorce settle which he has failed to comply.

Unfortunatly he has no property to apply for a charging order so the Court Ordered varied the final order for the lump sum to be recovered from his huge pension pot.

His employers who run the pension scheme have written back saying that under section 31 (4A) of the Matrimonial Causes Act 1973, a pension sharing order can only be amended before a decree is absoulte.

As this an execptional circumstance where do I stand legally?

I acted for my self during the proceeding.
